Hayward Toyota Settles With California Lemon Law Lawyer

Details of the Lawsuit Against Toyota of Hayward
Plaintiff Ms. Gordon-Brown, through her California lemon law lawyer, filed this legal action against Hayward Toyota on December 8, 2011. This lawsuit originates from Ms. Gordon-Brown’s acquisition of a Volkswagen Jetta from defendant Hayward Toyota. The complaint filed in this lawsuit alleged that Toyota of Hayward violated California’s Automobile Sales Finance Act and California’s lemon laws. Additionally, the complaint alleged that Hayward Toyota inaccurately stated the down payment amounts of the plaintiff’s Volkswagen Jetta contract in order to qualify her for a predatory car loan that she otherwise could not have qualified for.
In the complaint, plaintiff Ms. Gordon-Brown’s California lemon law lawyer further alleged that Toyota of Hayward breached the California lemon law’s implied warranty of merchantability due to the Volkswagen Jetta’s substandard condition. Ms. Gordon-Brown’s attorney alleged that the Jetta was in such a poor state that it became inoperable in less than one month after Ms. Gordon-Brown’s purchase.

Pursuant to the settlement, Toyota of Hayward will repurchase the Volkswagen Jetta, refund all of Ms. Gordon-Brown’s money, make an additional non-compensatory payment to Ms. Gordon-Brown, and pay the attorney’s fees charged by her California lemon law lawyer. Note: During the lawsuit Hayward Toyota denied all of Ms. Gordon-Brown’s allegations, and the settlement negotiated by Ms. Gordon-Brown’s lemon law attorney and Hayward Toyota does not contain any admission by Hayward Toyota that it committed any illegal or wrongful conduct.
