California Lemon Law Attorney Settles Lawsuit Filed Against West Covina Toyota Alleging Backdating of Automobile Purchase Contracts

West Covina Toyota lawsuit alleged that when the plaintiff, Enrique Cervantes, purchased a 2011 Toyota Tacoma from West Covina Toyota, that the Los Angeles County Toyota dealership illegally backdated the automobile purchase contract to an earlier date, thereby causing the Mr. Cervantes to be charged for illegal and undisclosed pre-transaction interest.
Mr. Cervantes’s lemon law attorney further alleged in the lawsuit that by virtue of the contract backdating Mr. Cervantes was entitled to rescind his vehicle purchase contract and get a refund for the money paid towards the vehicle.
Under the settlement, West Covina Toyota did not admit liability or wrongdoing, but agreed to repurchase Mr. Cervantes’s Toyota Tacoma, and to pay Mr. Cervantes’s attorney’s fees and costs.
Please note: West Covina Toyota denied all liability throughout the Cervantes v. West Covina Toyota lawsuit, and the court never determined whether or not West Covina Toyota had committed any illegal conduct.
